Trump Says He’s Spending $400 Million on the Midterms. A Watchdog Says He Can’t Direct a Dime of It.

Trump posted that he has spent or will spend over $400 million by Election Day, but a complaint at the FEC says a president cannot control super PAC money.

President Trump announced Tuesday in a Truth Social post that he has spent, or will be spending, “over 400 Million Dollars by Election Day” to help Republicans in the November 3 midterms. He wrote that more than $300 million of it has already gone to advertising and voter contact, and called it “my Great Honor” to do so. He did not say whether the money is his own or comes from MAGA Inc., the super PAC that raised it. That distinction is the whole legal question, and a campaign finance watchdog has already put it in front of federal regulators.

Step back and look at the sequence. On September 4, Trump told reporters in the Oval Office he would spend “whatever amount of money necessary,” and said the money was his and that he controls it. Within weeks, the Campaign Legal Center filed a complaint arguing that statement was an admission of a violation. Now he has put a headline number on the spending, again with no breakdown and no explanation of who is actually deciding where it goes.

The question the story forces is simple. Federal law is supposed to keep a super PAC independent of the candidates it supports. If the most powerful officeholder in the country says the money is his to command, what exactly is independent about it?

A number with no receipts

Start with what Trump actually said. His post claimed over $400 million, with more than $300 million already spent on “Advertising, Direct and Indirect Voter Contact,” according to Al Jazeera’s account of the post. USA Today reported that Trump appeared to be referring to MAGA Inc. money, and that he did not confirm whether any of it is his personal cash. Mediaite reported the same gap.

There is also a problem with the pace. MS NOW reported on September 4 that roughly $850 million had been amassed across Trump’s political operation but not meaningfully spent. MAGA Inc. spent $825,000 in July, all of it for Senate candidate Darline Graham in a South Carolina primary, according to that report. More than $400 million sits in MAGA Inc., which can spend directly on races. Another $450 million sits in a nonprofit arm that can advocate on policy but cannot promote individual campaigns.

So either an enormous amount of spending happened in the weeks since, or the $300 million figure is a claim that nobody outside his operation can check yet. No breakdown by race, vendor or date has been released.

The sentence that started a federal complaint

Super PACs can raise unlimited sums because they do not coordinate with candidates. That is the legal bargain. The Campaign Legal Center says Trump broke it out loud.

Saurav Ghosh of the Campaign Legal Center said “Our laws are clear: No federal officeholder or candidate is allowed to direct the money raised or spent by a super PAC.” The group called Trump’s Oval Office remark “a remarkable admission of a serious campaign finance violation” and asked for “appropriate sanctions for any and all violations,” Common Dreams reported on September 25. That is the watchdog’s allegation. No ruling from the Federal Election Commission has been reported.

Trump has not walked it back. On October 5, he said he would pay for a set of patriotic ads “myself, and with money I raised for MAGA, Inc.,” per Mediaite. That phrasing blurs the line again, putting a super PAC’s money and his own pocket in the same sentence.

What’s actually happening beneath the surface

Money is not the only thing in short supply. A Reuters/Ipsos poll this week found 31 percent of Americans approve of Trump’s job performance, Al Jazeera reported. According to the same account of Reuters reporting, Trump has asked why the super PAC’s large outlays have not lifted Republican polling in key races, Ohio among them.

That detail matters more than the dollar figure. A president who is asking why the money isn’t working is not a bystander to how it is being spent. USA Today reports Democrats are strong favorites to win the House and increasingly confident about the Senate, which is the backdrop for a 32-day campaign blitz with stops planned in South Carolina and Iowa.

Seen this way, the Truth Social post reads as less of a disclosure and more of a signal. It tells candidates the cash is coming. It tells donors the boss is watching. And it tells the public a number big enough to dominate the news cycle while leaving out the details that would let anyone test it. MS NOW’s September report, headlined “Trump sits on $850 million as Republicans wait,” suggests the pressure runs in both directions.

What to watch

First, whether the FEC acts on the complaint. Enforcement there is slow, and the election is 13 days away. Second, the filings. Pre-election reports will show where MAGA Inc. money went and when, which is the first real chance to compare the $300 million claim with a paper trail. Third, whether any Republican candidate is asked, on the record, whether the president’s operation is coordinating with their campaign.

The legal fight is narrow, but the principle is not. Campaign finance rules exist so that the people who write the biggest checks and the people who hold power are not the same hand. If a president can say the money is his, spend it where he wants and call it independent, then the rule is a suggestion. Voters deserve to know which version of the law applies when the person at the center is Donald Trump.
